Terms of Service

By accessing or using MatchPool ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

These terms constitute a legally binding agreement between you and The JKO Digital Trust (ABN 94 929 849 241), trading as MatchPool, established in Victoria, Australia.

You must be at least 18 years of age to use MatchPool.

By creating an account, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into this agreement
• You will provide accurate and truthful information during registration

When you create an account, you agree to:

• Maintain the security and confidentiality of your login credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account
• Maintain only one account per person
• Keep your account information accurate and up to date

Your username is publicly visible on leaderboards and in group competitions. All other personal information (email, name) is kept private.

Free Competition

MatchPool offers a free-to-play competition where users predict the outcomes of FIFA World Cup matches. The free competition:

• Costs nothing to join or participate in
• Provides access to the global leaderboard, statistics, groups, and all tipping features
• Does not involve real money prizes

Pro Subscription

MatchPool Pro is an optional paid subscription that provides access to premium features including advanced analytics, head-to-head comparisons, interactive charts, group insights, and smart notifications.

• Price: A$9 (one-time payment)
• Valid through: July 20, 2026 (end of the FIFA World Cup 2026 tournament)
• Pro does not renew automatically — there are no recurring charges
• Pro features are clearly marked throughout the Service

Pro subscription payments are processed securely through Stripe, a PCI-DSS Level 1 certified payment processor. MatchPool does not store, process, or have access to your full credit card details.

By making a payment, you agree to Stripe's Terms of Service and Privacy Policy.

Pro subscription refunds:

• Within 7 days of purchase: Full refund available upon request if you have not used any Pro features
• After 7 days: Refunds are not available, as the subscription provides immediate access to premium features

Nothing in this refund policy excludes, restricts, or modifies any rights you may have under applicable consumer protection legislation, including the Australian Consumer Law.

You agree not to:

• Create multiple accounts or share accounts with others
• Use automated tools, bots, or scripts to interact with the Service
• Attempt to manipulate competition results or leaderboards
• Collude with other users to gain an unfair advantage
• Interfere with or disrupt the Service or its infrastructure
• Misrepresent your identity or age

The MatchPool name, logo, and all related content, features, and functionality are owned by MatchPool and are protected by copyright, trademark, and other intellectual property laws.

Match data, team information, and tournament schedules are sourced from third-party providers and remain the property of their respective owners.

To the fullest extent permitted by law:

• MatchPool is provided on an "as is" and "as available" basis without warranties of any kind
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you have paid to us in the preceding 12 months
• We are not responsible for losses arising from service interruptions, technical failures, or data loss

We make reasonable efforts to ensure the accuracy of match results and scoring, but we do not guarantee the absence of errors. In the event of a scoring error, we will make corrections as soon as practicable.

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in prohibited conduct
• Are found to be underage
• Have not used your account for an extended period

You may delete your account at any time by contacting [email protected]. Deleting your account does not entitle you to a refund of any Pro subscription purchase.

These Terms of Service are governed by the laws of Victoria, Australia, and the laws of the Commonwealth of Australia applicable therein.

Any dispute arising from these Terms or your use of the Service will first be subject to good-faith negotiation between the parties for a period of 30 days. If the dispute is not resolved within that period, either party may refer the matter to the Victorian Civil and Administrative Tribunal (VCAT) or another appropriate court or tribunal with jurisdiction.

Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.

We may update these Terms of Service from time to time. When we do, we will:

• Update the version number and effective date at the top of this page
• Notify registered users by email of material changes
• Require re-acceptance of updated terms for continued use

Continued use of the Service after changes are posted constitutes acceptance of the revised terms.
